Terms of Service

Welcome to Speedcheck ("the App"), developed and operated by Left Field Logic, LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Speedcheck, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. We reserve the right to update or modify these Terms at any time. Continued use of the App after any changes constitutes acceptance of the revised Terms.

2. Description of Service

Speedcheck is a network speed testing application that measures your internet connection's download speed, upload speed, and latency. The App uses Cloudflare's network infrastructure to perform speed tests. Your use of the speed testing functionality is also subject to Cloudflare's Terms of Service.

3. Data and Privacy

Speedcheck does not collect, store, or share any personal information with us or any third parties. Your speed test results are stored locally on your device and may be synced across your devices using Apple's iCloud service if you are signed in with your Apple Account and have iCloud enabled for the App. We do not have access to your test results or any data stored in your iCloud account. Your use of iCloud is governed by Apple's terms and conditions.

4. User Responsibilities

You agree to:

Use the App only for lawful purposes and in accordance with these Terms.
Not attempt to reverse engineer, decompile, or disassemble the App.
Not use the App in any way that could damage, disable, or impair the App or interfere with any other party's use of the App.
Not use the App for any commercial benchmarking or competitive analysis purposes without our prior written consent.

5. Accuracy of Results

Speed test results are provided for informational purposes only. Results may vary based on numerous factors including but not limited to network conditions, server load, device performance, and time of day. We do not guarantee the accuracy, completeness, or reliability of any test results. Speed test results should not be used as the sole basis for any decisions regarding your internet service.

6. Intellectual Property

The App and all of its content, features, and functionality (including but not limited to design, text, graphics, logos, and software) are owned by Left Field Logic, LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Third-Party Services

The App relies on third-party services, including Cloudflare for speed testing and Apple iCloud for data synchronization. We are not responsible for the availability, accuracy, or reliability of these third-party services. Your use of third-party services is subject to their respective terms and conditions.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LEFT FIELD LOGIC, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR DATA; OR (C) ANY OTHER MATTER RELATED TO THE APP.

10. Indemnification

You agree to indemnify, defend, and hold harmless Left Field Logic, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or your violation of these Terms.

11. Termination

You may stop using the App at any time. You may also withdraw your consent to these Terms through the App's Settings, which will return you to the welcome screen and prevent further use until you agree again. We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and Left Field Logic, LLC regarding your use of the App and supersede all prior agreements and understandings, whether written or oral.
